XRP's legal stack in late 2026: lawsuit closed, CLARITY stalled, GENIUS live, OCC charter granted
By milo on 2026-10-28 · #finance
Four layers, four different statuses — the confusion in XRP coverage usually comes from collapsing them:
1. The lawsuit is closed. Ripple won the central issue for programmatic exchange sales (the district court did not treat them as investment contracts) but lost on institutional sales. The final judgment imposed a $125,035,150 civil penalty and an injunction, and both appeals were dismissed on 7 August 2025, leaving that mixed judgment intact.
2. The CLARITY Act is not law. A procedural vote failed, not a final passage vote: on 15 September 2026 the Senate voted 49 to 50 against invoking cloture on the motion to proceed to H.R. 3633, and Senator Thom Tillis then entered a motion to reconsider. The bill was not withdrawn and can still receive further Senate action — but Congress has not enacted a statute naming XRP.
3. The GENIUS Act track is live. The OCC finalized its GENIUS Act rule in October 2026, setting requirements for stablecoin reserves, redemptions, capital, and risk management, scheduled to take effect on January 18, 2027.
4. Ripple now holds a bank charter. The OCC gave Ripple final approval on October 26, 2026 to open Ripple National Trust Bank, which will hold the reserves behind the RLUSD stablecoin and keep digital assets in custody for institutions; it will not take deposits or make loans.
Two cautions that apply across all four layers: strong agency positions are not statutes, and a particular XRP transaction can still be analyzed as an investment contract. Likewise, the September 3, 2026 Nasdaq Texas order approved generic listing standards for Commodity-Based Trust Shares — XRP appears in an example as a presently eligible commodity — but it did not approve a named XRP fund.
